Former Cape Cod Rowing Coach Charged With Child Rape Dating to 2007: Why There Is No Time Limit

A former Cape Cod rowing coach was arrested in New York on child rape charges from 2007 to 2009. Massachusetts has no time limit for those charges. Here is the law.

A former Cape Cod rowing coach, Guy Monseair, 57, was arrested in the Bronx on Thursday, November 5, 2026, on child rape charges from his years coaching with rowing clubs on Cape Cod, Barnstable police said, according to Boston.com, NBC10 Boston and Boston 25 News. He is awaiting extradition to Massachusetts. He is presumed innocent.

Monseair is charged with four counts of aggravated statutory rape of a child and one count of indecent assault and battery on a child under 14, all three outlets reported. Charging documents indicate two of the alleged rapes occurred in March 2008 and two about a year later, and the indecent assault and battery charge dates to 2007, Boston.com reported.

The arrest

Barnstable police said they received information last month about sexual assault and rape allegations from his time coaching with several Cape Cod clubs, Boston.com and Boston 25 reported. Police obtained an arrest warrant and took him into custody in the Bronx, where he lived and was still coaching, with help from the NYPD and Homeland Security Investigations, according to the outlets. Boston.com reported he was most recently coaching with City Island Rowing, an all-girls club.

“This investigation remains active and ongoing,” the department said, according to Boston.com, which reported that police asked anyone with information to contact Barnstable detectives.

USRowing, the sport’s national governing body, permanently revoked his membership on Thursday, Boston.com reported. Cape Cod Rowing said in a statement that its current organization does not have information about the timeframe of his involvement or the circumstances of his coaching. No outlet reported that he had a lawyer who could comment.

Why charges from 2007 to 2009 can be brought now

Most Massachusetts crimes must be charged within six years. Child sexual offenses are different. Under G.L. c. 277, § 63, which we read at malegislature.gov, an indictment or complaint for offenses including aggravated statutory rape (c. 265, § 23A) and indecent assault and battery on a child under 14 (c. 265, § 13B) “may be found and filed at any time after the date of the commission of such offense.”

There is one condition for older cases. A charge “found and filed more than 27 years after the date of commission” must be “supported by independent evidence that corroborates the victim’s allegation,” and that evidence “shall not consist exclusively of the opinions of mental health professionals.” The conduct alleged here is roughly 17 to 19 years old, so that corroboration requirement would not apply under the statute as written.

Limitations questions can turn on which version of a statute applied when, and we have not seen the charging documents, so a court may have more to say about timing.

What the charges mean

Charge What the statute covers Penalty as the statute now reads
Aggravated statutory rape, c. 265, § 23A Intercourse with a child under 16 where there is a large age gap (more than 5 years if the child is under 12, more than 10 years if the child is 12 to 16) or the defendant was a mandated reporter Life or any term of years, with a 10 year mandatory minimum
Indecent assault and battery on a child under 14, c. 265, § 13B Indecent touching of a child under 14, who “shall be deemed incapable of consenting” Up to 10 years in state prison or 2.5 years in a house of correction

Neither charge can be resolved with a continuance without a finding or placed on file, both sections say. The penalty that would apply to conduct from 2007 to 2009 depends on the law in effect at the time. Police have not said how old the alleged victims were beyond the statutory categories, and we are not identifying them.

What happens next

Monseair must be returned to Massachusetts before he can be arraigned here. Online records did not list a date for his Barnstable District Court arraignment, Boston.com reported.
